Smoking is prohibited near playground equipment in Western Australia
Smoking restrictions prohibit (ban) smoking within 10 m of any children’s playground equipment in Western Australia that is:
- in a public place or a part of a public place
- not in an enclosed public place.
This law applies to:
- local government parks and gardens
- State owned facilities such as Kings Park
- children’s playground equipment in hotels, fast food outlets, eateries and sporting venues.
Signs
‘No smoking’ or ‘Smoking prohibited’ signs may be displayed near all children’s playground equipment to make clear that smoking is not permitted within 10 m of this equipment.
Who enforces the smoking ban?
Local governments are mainly responsible for enforcing matters about smoking within 10 m of children’s playground equipment. The laws allow local governments to appoint environmental health officers or additional officers, for example rangers, to assist with enforcement.

There has been a very high level of public support for this legislation from the Western Australian public.
Penalties
If you smoke within 10 m of any children’s playground equipment the following penalties (fines) may apply:
- maximum court imposed penalty – $1000
- infringement notice – $200.
