New tobacco and vape laws now in effect
Penalties of up to $21 million and 15 years’ imprisonment are now in effect to combat the sale, supply and possession of illegal tobacco or vaping products. Learn more about new tobacco and vaping laws in Western Australia.
Authorities now have stronger enforcement powers and can close premises that are found to be selling, supplying or storing illicit tobacco and vaping products.
Under the new laws, all smoke‑free public places will also become vape‑free, helping to reduce exposure to second-hand vape emissions and protect the community.
Compliance activity will increase across the state, supported by a significant boost to Department of Health’s enforcement capacity.
The reforms target illegal activity – tobacco sellers who hold a valid licence and comply with legal requirements will not be affected.
The stronger laws have been introduced to help prevent smoking and vaping causing serious harm to health and are designed to safeguard the health of children and young people.
Anyone with information about the sale of illicit tobacco or vaping products is encouraged to report it to the Department of Health or anonymously via Crime Stoppers.
