New tobacco and vape laws coming soon

Tough new penalties will soon be in effect to combat the sale, supply and possession of illegal tobacco or vaping products.

A maximum penalty of $4.2 million for individuals and $21 million for companies may apply for possession of a large commercial quantity of illegal tobacco or vaping products. People involved may also face up to 15 years in prison.

Under the new laws, WA Health’s expanded Tobacco and Vape Compliance Unit will have power to close stores suspected of illegal trade for up to 90 days.

In addition, all smoke‑free public places will become vape‑free, helping to reduce exposure to second-hand vape aerosol and protect the community.

Anyone with information about the sale of illicit tobacco or vaping products is encouraged to report it to the Department of Health:

You can also report anonymously to Crime Stoppers by calling 1800 333 000 (free call within Australia) or crimestopperswa.com.au (external site)

Smoking and vaping cause serious harm to health and the stronger laws are designed to help keep our communities safe - especially children and young people.

Support is available for people who want to quit smoking or vaping:

The new laws were passed by State Parliament in March 2026 and are expected to be implemented soon. Stay updated here.
