The Health Department of Western Australia was established by the Governor under Section 35 of the Public Sector Management Act 1994. The Department, under the Commissioner of Health, is responsible to the Minister for Health for the efficient and effective management of the organisation. The Department administers 39 Acts and 89 sets of subsidiary legislation.

The Mental Health Act is a major innovation and received bipartisan support following years of consultation and negotiation. The Act establishes a Mental Health Review Board which will review the status of involuntary patients and significantly increases protection for involuntary patients.

Hospitals and Health Services Act 1927

As at 30 June 1997, there were 7 metropolitan hospital and health service boards and 61 country hospital and health service boards appointed under section 15.
