What if I don’t make a report, based on my belief that there are insufficient grounds to warrant a report, and then the child is subsequently found to have been sexually abused?
If you made a decision in good faith, based on professional judgement and with the information available to you at the time, that there was no sufficient basis to form a belief on reasonable grounds, it is unlikely that you will be found to have breached your mandatory reporting obligations.
Any decision not to make a report to the Department for Child Protection should be properly documented.
