Health Services Union - Department of Health - Health Service Salaried Officers State Industrial Agreement 2004 Christmas Holiday Arrangements 2005
This circular clarifes the intent and application of amendments to the Health Services Union - Department of Health - Health Service Salaried Officers State Industrial Agreement 2004 reported in Operational Circular OP 2001/05, in respect of the 2005 Christmas Holidays arrangements for shift workers.
In Clause 22. - Public Holidays subclause (3)(b) implies that for shift workers only, where Boxing Day falls on a Monday, it will be observed on that day."
Consistent with that interpretation, the 2005 Christmas Holiday payment arrangements for shift workers will be;
(* Other than where salary averaging arrangements are in place.)
A shiftworker will only receive the 175% on Tuesday if both Sunday, 25 December and Tuesday, 27 December are worked. Tuesday 27 December is not treated as a public holiday in this circumstance.
The exception is for part time shift workers whose contracted hours of work include Tuesday, 27 December, but not Sunday 25 December. In this circumstance, Tuesday 27 December is treated as a public holiday.
The above information only applies to shift workers for the 2005 Christmas holiday period.
